Terms and Conditions for Psychological Services
1. This 10 clause document specifies the Terms and Conditions for the provision of a psychological service to you, the Client, by your Psychologist, Andrea Breninek. The Terms and Conditions specified take precedence over all other regulatory provisions. The applicable version of these Terms and Conditions is the most recent. English Law and English Courts shall have exclusive jurisdiction over any disputes. All communication between the Client and Andrea Breninek will be in English unless both parties agree to communicate in German.
2. By electing to book or attend sessions with Andrea Breninek, the Client confirms their acceptance of these Terms and Conditions. These Terms and Conditions shall also apply to any other person the client elects to bring with them to one or more sessions. Any verified mutual agreement to modify any clause contained herein does not invalidate any other clause(s).
3. Andrea Breninek is a Clinical Psychologist and Cognitive Behavioural Psychotherapist, accredited by both the British Association for Behavioural and Cognitive Psychotherapies (BABCP) and the Health and Care Professionals Council (HCPC). Andrea Breninek is not a medical doctor, and clients must seek the advice of their General Practitioner regarding any medical concerns. If Andrea Breninek recommends a colleague to the Client for any additional professional service, any such recommendation is made in good faith, and the Client understands and accepts that Andrea Breninek cannot take responsibility for the performance of any such third party. It is for the Client to determine whether or not they wish to retain the services of any such other professional.
4. The provision of this psychological service is a collaborative process and it relies upon an appropriately authentic engagement and clear communication by both the Psychologist and the Client. If the Client were ever to become even minimally dissatisfied with any aspect of the service, it is an essential requirement and the Client’s personal responsibility to inform Andrea Breninek of this as quickly as possible, preferably within 24 hours but, at the very latest, within 7 days. Concerns may be communicated by any method(s) the Client chooses, provided that receipt of any message(s) can be confirmed. All such communications should be between the Client and Andrea Breninek and not through a third party. Thereby, swift action can be agreed to resolve a problem and to prevent its recurrence.
5. Clients are welcome to make overt electronic recordings of any or all sessions if they choose, exclusively for their own personal use. Additionally, clients are encouraged to make handwritten notes during sessions of any agreed suggestions or interventions.
6. The timing, duration, frequency and number of sessions provided are arranged by mutual agreement between the Client and Andrea Breninek.
7. The professional fees are normally based upon hourly sessions and are charged at the currently agreed figure. A clinical session lasts for 50 minutes. The Client is responsible for the prompt payment of the full fees incurred whether or not they intend to claim reimbursement in part or in full from a third party, e.g. a medical insurer. Clients must make their own determination as to their ability to afford the service and when they judge it is appropriate to phase out the sessions. Domiciliary visits are subject to an additional fee. Additional work on behalf of the Client undertaken out of sessions by Andrea Breninek may be chargeable on a pro rata basis. All fees are subject to annual review.
8. Fees are due at the end of each session. In case of late payment clients are liable for: a) late payment charges and re-invoicing fees of £30 for each unpaid reminder, and b) interest accruing on overdue fees at 10% per annum above the prevailing Barclays Bank base rate, from the date of the original invoice until full payment is received. Unwarranted disputes regarding fee payments that require detailed written explanations are subject to a £50 fee for each missive from this office. In the event of default, the Client will be liable for all additional fees associated with the debt collection process.
9. We are not able to make ‘provisional bookings’ for sessions. If a client elects to book a session, the session is due to take place at the specified time and place, and to be charged for at the agreed fee. Clients are welcome to cancel any session with at least 60 hours’ notice. If the Client fails to meet a prearranged appointment, or cancels a session with less than 60 hours' notice they are liable for ½ of the full sessional fee.
24 hours’ notice, they are liable for the full sessional fee.
10. The Client has the unfettered right to withdraw from the psychological service at any stage. Andrea Breninek also has the right to withdraw from continuing to provide the service if she judges that the Client may not benefit from further sessions with her.
